The Website offers an online apartment reservation service, which means a 24-hour service, simple, direct, and with all the advantages of having a wide catalog of updated and available apartments from any location through an Internet connection.

1. General Information

All prices are in Euros and, in accordance with current regulations, any reservation made through the Website will be subject to the Value Added Tax (VAT), and this amount is included in the price.

The Owner reserves the right to modify its prices at any time, but the reservation prices of the apartment will be invoiced based on the rates in force at the time of the reservation, except for manifest typographical errors.

Once formalized, an email will be sent to the User with the details of their reservation.

At the time of booking, 100% of the total amount will be charged.

2. User Obligations

Any User making a reservation through this Website declares to be of legal age and, if applicable, with full capacity to use payment methods with sufficient funds to cover all costs arising from the reservation of products. The User also declares to fully and unreservedly accept all the conditions of this Legal Notice.

The User may place one or more requests for the contracting of services offered through the Website.

By placing an order, the User accepts the specifications and characteristics of the offered service. In this regard, the Owner indicates that the services shown in the photographs on this Website may differ slightly from the final service in terms of sizes, colors, components, etc., due to the availability of suppliers. The purpose of the photographs is to guide the User or suggest a presentation, without constituting contractual images. The Owner ensures in any case that these differences will not imply a lower quality of the services.

3. Payment Methods and Security

In compliance with Directive (EU) 2015/2366 of the European Parliament and Council of November 25, 2015, on payment services in the internal market, the User making an online payment transaction must do so through strong authentication. Depending on the chosen payment method and economic value, with exceptions provided for in the Directive, the User must provide a second identification factor before placing an order, such as a PIN code sent to the User’s mobile phone, which must be entered to validate their purchase.

According to the PSD2 directive, strong authentication exists when at least two of the following elements are used for authentication:

  • Knowledge (something the User knows, e.g., password, PIN code, access data, etc.)
  • Possession (something the User has, e.g., a mobile phone to receive an SMS to verify the transaction, email address, etc.)
  • Inherence (something the User is, e.g., biometric verification, whether by fingerprint, facial recognition, etc.)

These elements are independent of each other. That is, the compromise of one does not affect the reliability of the others, and confidentiality of identification data is always protected.

The payment method for making the reservation will be by Credit Card:

  • This payment method is immediate, fully secure, and verified by Redsýs’ secure servers on the payment gateway. Under no circumstances will credit card data be disclosed.
  • Accepted cards include Visa, 4B, Maestro, and MasterCard.
  • Only secure credit cards will be accepted to prevent any possible risk or fraud. Secure cards are associated with security keys, and at the end of the payment process, the payment gateway of the bank will prompt for these keys. If the card does not have online payment security, the bank must provide the necessary information and security keys.

4. Right of Withdrawal

According to Law 3/2014, of March 27, amending the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, in Article 103, the right of withdrawal does not apply to contracts relating to (among others):

  • The provision of accommodation services for purposes other than housing, transportation of goods, car rentals, food, or services related to leisure activities, if the contracts specify a specific date or period of execution.

Regarding this section, with the User’s order, they give their prior express consent, with acknowledgment and acceptance of the exceptions outlined here, and consequently, in these cases, they waive their right of withdrawal.

5. Changes, Cancellations, and Terminations

For any modification or cancellation of the reservation, the User must contact the Owner at (+34) 617 212 754.

The cancellation penalty will be a percentage of the total reservation, including taxes, according to the following rules detailed below:

High Season:

  • From 15 days to 7 days before arrival: 50%.
  • Less than 7 days, No Shows, and early departures: 100%.

Low Season:

  • From 7 days to 2 days before arrival: 30%.
  • Less than 2 days: 75%.
  • No Shows and early departures: 100%.

6. Availability

The Owner agrees not to make unavailable apartments available to Users except due to a computer error or any other unforeseen situation. In the event of such an unfortunate incident, the Owner agrees to inform the User and reach a satisfactory agreement with them.

8. Online Dispute Resolution
